  1. About TFP AU PTY LTD
    • Your purchase of goods from TFP AU PTY LTD is subject to these Terms and Conditions of Sale (“Terms”), the Website Terms of Use and any Catalogue Terms. If you do not accept these Terms, you must refrain from using this website or making a purchase from this website or in store.
    • The goods and services described in this website are available from TFP AU PTY LTD’s website only (unless the goods or services are specified as “available in store only”), and will be available for you to make an offer to TFP AU PTY LTD via the website to purchase at the specified price on or before the end date specified in a current catalogue, or until otherwise removed from the website or as specified, and where TFP AU PTY LTD accepts your offer, TFP AU PTY LTD will sell the goods or services to you in accordance with these Terms and any Catalogue Terms.
    • You and TFP AU PTY LTD may enter into a sale contract for the sale and supply of products, by you making an offer to TFP AU PTY LTD via the website, to purchase goods at the specified price, subject to these Terms.

      In these terms:
      - "you", "user", "member", and “guest” means anyone who visits us in store and/or uses this website.
      - a reference to a “third party” in these terms includes a reference to any agent or contractor of TFP AU PTY LTD,  or of any of their related bodies corporate, and any person engaged by any of them, in the creation, provision or maintenance of the website or in the fulfillment of Orders made through the website, and includes any of them.
      - a reference to the "websites" means www.thefurniturepeople.com.au
      - "Order" means an offer made by you in response to an invitation to treat made by TFP AU PTY LTD via the website.
  2. User Agreement
    • By accessing and/or using the website, you accept these terms and agree to be bound by them, and an agreement is formed between us and you.
    • These Terms may be amended at any time without notice and your access to this website may be terminated at any time without notice. Your continued use of the website following such amendment of these Terms will represent an agreement by you to be bound by these Terms as amended. We recommend you review the terms for amendments each time you use the website and before placing any Order. Should we choose to provide you with notice of amended terms, you agree to receive email notification of the amendments from us or our third party.
  3. Guests and Registered Users
    • You may access and/or use the website as a guest or as a member.
    • To become a member of the website, you must provide your name and address, telephone number, a valid email address and nominate a password. If you do not provide accurate and complete details we may not be able to activate your membership or supply products to you. You agree to keep your membership details current at all times by accessing your account via the website or by contacting our Customer First Team.
    • You will receive an email from us as soon as practicable after you create your membership account.
    • We only permit one registration per email address.
    • You must not use another members’ account without permission.
    • You must keep your password secure as you are responsible for any activity on your account. You agree to notify us immediately if you become aware of any security breach or any unauthorized use of your password or account.
    • If you forget your password you may click on the relevant link located on the website and we will email you a new password, or you may contact us.
    • We reserve the right to terminate a member’s account without notice for any reason whatsoever including without limitation, if you have breached or we suspect you have breached these terms.
  4. Legal Capacity
    • You must be eighteen (18) years of age or over to register as a member of the website or purchase products from the website.
    • Any Order and/or purchase made by you using this website is an acknowledgement by you that you:
      1. are over the age of eighteen (18) years;
      2. accept these terms;
      3. agree that you have entered into a legal contract with TFP AU PTY LTD in relation to these terms; and
      4. these terms, together with your order, constitute the entire agreement between you and TFP AU PTY LTD for the supply of products.
    • TFP AU PTY LTD reserves the right to take legal action and seek compensation from the parent or guardian of a minor who causes an order to be placed, for any loss or damage TFP AU PTY LTD may suffer as a result of a transaction entered into by a minor.
  5. Refund Policy/Orders
    • Please choose carefully as refunds are not provided where you have simply changed your mind, made a wrong selection or simply found the item cheaper elsewhere. We recommend you carefully choose before purchasing with us.
      In certain circumstances (at TFP AU PTY LTD’s discretion) , should TFP AU PTY LTD agree to issue a refund for a purchase, you will be charged an administration fee of $150. You will be required to return the goods purchased to the warehouse within 5 business days of the goods being delivered to you unless otherwise agreed (if applicable). Refunds may take up to 6 weeks to be processed, and this will only be done once the goods have been checked to ensure they have been returned in good condition. It is your responsibility to ensure that the goods are returned in good condition , on time and to arrange delivery back to the warehouse. All delivery charges are payable by you.
      In certain circumstances (at TFP AU PTY LTD’s discretion) , should TFP AU PTY LTD agree to issue a refund for a purchase that is still at the order stage, your deposit may be converted to a store credit valid for 1 year from your invoice date after which the deposit will be voided.
    • We do not exchange goods. We recommend you visit the warehouse to view the products before purchasing where possible. If you purchase online and did not view the products before purchasing and change your mind later, we will not exchange the goods because they are deemed as ‘used’.
      In certain circumstances (at TFP AU PTY LTD’s discretion), should TFP AU PTY LTD agree to exchange your goods, you will be charged an administration fee of $150. You will be required to return the goods purchased to the warehouse within 5 business days unless otherwise agreed. It is your responsibility to return the goods to the warehouse in good condition, on time and to arrange delivery back to the warehouse. Before returning the goods you will need to choose another product and pay for any difference in price if any. Once the goods are returned and payment received (if any) within 5 business days of being delivered to you, TFP AU PTY LTD will then arrange for the exchange. All delivery charges are payable by you.
    • Representations of products for sale made by TFP AU PTY LTD via the website do not constitute an offer to sell but an invitation to treat.
    • You and TFP AU PTY LTD may enter into a contract for the sale and supply of products by you making an offer via the website to purchase a product at the price advertised on the website by:
      1. placing an electronic Order for the products using the website; 
      2. you confirming the Order details in accordance with the procedure on the website; 
      3. you making payment in full (plus any applicable delivery charges) on the website; and
    • When entering into a sale contract via the website, you will be taken to have communicated your offer to purchase the product(s) only when:
      1. any requirements set out in these terms have been met;
      2. the electronic instruction containing the offer from you enters and is recorded in our database;
      3. a record is created and stored in our database; and
      4. TFP AU PTY LTD receives in its account full payment from you for the product (including any applicable delivery and handling charges) and confirmation of that payment is received by our database.
    • You acknowledge that:
      1. the transmission of your offer or the confirmation of any payment, made through an electronic instruction may not be received by TFP AU PTY LTD for reasons beyond either parties' reasonable control including but not limited to, electronic failure, mechanical, software, computer, or telecommunications, or the omission or failure of third party website providers or systems; 
      2. to the extent permitted by law, TFP AU PTY LTD is not liable to you in any way for any loss or damage at all and however caused, arising directly or indirectly in connection with the transmission of an electronic instruction through the website, or any failure to receive an electronic instruction for whatever reason;
      3. TFP AU PTY LTD may act on and process all completed electronic instructions transmitted or issued through the website without further consent from or reference to you; and 
      4. TFP AU PTY LTD may treat an electronic instruction as authentic and is under no obligation to investigate the authenticity or authority of persons issuing or transmitting such electronic instructions, or to verify the accuracy and completeness of such electronic instructions.
    • You will receive an email from TFP AU PTY LTD as soon as practicable after you have confirmed your Order and made payment. If you have any questions regarding your Order you may contact us.
    • If your Order is not accepted by TFP AU PTY LTD, TFP AU PTY LTD will notify you by telephone or email and arrange for a full refund of any payment made by you to be processed.
    • TFP AU PTY LTD may, in its sole and absolute discretion, accept or reject any offer made by you for any reason (or no reason), including an error in the advertised price for, or description of, the products on the website, or an error in your Order.
    • Any representations made about stock availabilities are accurate to the last known stock level and are subject to change. If TFP AU PTY LTD cannot supply a particular product, TFP AU PTY LTD will notify you by telephone or email as soon as possible.
    • TFP AU PTY LTD will be deemed to have accepted your Order on the first to occur of issue to you by email of a tax invoice for the sale and the fulfillment of your Order.
  6. Price
    • Prices shown are in Australian dollars and include GST where applicable. Prices may not include delivery and handling charges. Prices are subject to change.
    • Each published saving in respect of a product is by reference to the lower of the recommended retail price of the manufacturer or the normal ticketed price of TFP AU PTY LTD.
    • Images of products shown without any advertised price beside that image are not offered for sale.
    • Unless otherwise stated, any accessories shown in any image of products are not included in the price.
    • We reserve the right to correct any errors published on the website.
  7. Payment
    • All payments must be made in full prior to delivery.
    • Payments must be made via PayPal secure payment gateway facilities accessible via the website and will be subject to any terms and conditions of these providers.
  8. Supply and Delivery
    • When you purchase a product, we deliver the one available in our warehouse/s unless the item is out of stock. We do not have the concept of 'floor stock'. If you are unhappy with the item in our warehouse and would like to place a new order instead, please specifically request for it. Please note that if you choose to do so, the price of the new order might differ to the one available at the warehouse at the time.
    • Subject to you complying with these Terms and acceptance of your Order by TFP AU PTY LTD, TFP AU PTY LTD will sell and supply the products to you as shown on your Order confirmation.
    • Products may not be available for immediate delivery. TFP AU PTY LTD will endeavor to deliver your Order to you within ten (10) business days of the date you placed your Order, except if the Order is not available in stock and needs to be ordered.
    • Items not held in stock will need to be ordered. You agree that your Order for any item of furniture may take up to twenty (20) weeks to be delivered to you from the date you placed your Order. This time frame may vary depending on the product you ordered and is the average manufacturing lead time required by suppliers. TFP AU PTY LTD will contact you on receipt of your Order to notify you of the indicative delivery date. 
    • When you complete your Order you will be prompted to select whether you wish to collect your Order from our warehouses or to have the Order delivered to an address specified by you.
    • Other than in respect of Orders for furniture, regional or remote areas, if TFP AU PTY LTD gives you notice that it will be unable to deliver your Order within 10 business days of receipt of your Order, due to lack of stock, you may cancel your Order without charge, and TFP AU PTY LTD will arrange for a full refund of any payment made by you to be processed.
    • Delivery times may be greater than 10 business days for regional or remote areas.
  9. Delivery by third party contractors.
    • The terms of this clause apply where you select to have your goods delivered to a specified address using our third party delivery service.
    • Please note that TFP AU PTY LTD or its contractors take no responsibility if your door is too small and the items do not fit through. It is your responsibility to measure your door width and ensuring appropriate access prior to purchasing any item.
    • We offer free delivery in limited circumstances. This offer might not apply to items on promotion or if you already benefited from a discount or any other offers.
    • We offer a discounted price for interstate deliveries. Each delivery is subject to its own costs and you should check the costs involved before placing your order. Delivery tariffs are subject to change at any time without notice.
    • The delivery address must be an address within Australia and cannot be a freight forwarding location. Deliveries cannot be made to PO Boxes.
    • On acceptance of your Order by TFP AU PTY LTD, your Order will be dispatched to your specified delivery address generally within 10 business days of the date you placed your Order.
    • If you Order large or bulky items, TFP AU PTY LTD will contact you by telephone or email to arrange with you a suitable time for delivery.
    • You will be required to be available in person to accept delivery of your Order.
    • If you wish to change the delivery date or delivery address you must let us know at least 48 hours prior to the dispatch of your Order.
    • TFP AU PTY LTD will use its best endeavours to deliver your Order within any stated timeframes for dispatch, however TFP AU PTY LTD does not warrant that these timeframes will always be met, as many factors may affect these timeframes.
    • You must advise at the time you place your Order via the website or later when you discuss delivery with TFP AU PTY LTD, of any difficulties that may be involved in the delivery (such as stairs or narrow entries). If you do not state the situation correctly and on arrival the delivery contractor deems it to be a difficult location you will be liable for any extra charges including redelivery fees and the cost of an extra person to assist.
    • TFP AU PTY LTD cannot and will not accept responsibility for delivery failures, delays or damages to the client's premises by our third party delivery contractor.
    • TFP AU PTY LTD does not offer an in house delivery service. We hire third party contractors to deliver to you and we will provide you with a quote upon your purchase.  You are welcome to find your own quotes. TFP AU PTY LTD will liaise with the contractors on your behalf should you decide to use one of them. All delivery charges are payable directly to our third party contractors. The delivery fees are applicable even if you refuse to accept delivery.
    • We do not offer rubbish removal services for packaging materials. Some of our third party contractors will offer to remove and dispose of your rubbish at a fee and it is at their discretion.
  10. Pick Ups

    • The terms of this clause apply where you select to pick up your items from our warehouse.
    • A time needs to be scheduled prior to pick up.
    • Please ensure you have the help required to load your items on your vehicle as help from our staff is not available during pick ups. The goods will be made available to you from the door of our warehouse and you will need to handle your items from this point on.
    • You will be asked to sign a delivery note certifying that your goods are being received in good condition prior to loading. Please take the time to thoroughly check your item. Once signed, TFP AU PTY LTD will accept no responsibility for damaged goods.
    • Scheduled Pick-Up : will take no responsibility if your goods are damaged during transportation.
    • Packing Information : Our furniture is carefully packed in carton boxes and canvas covers. However, these materials might not be completely waterproof.
    • Rainy Day Precautions: : If you need to pick up your order during rainy weather, we kindly ask you to bring suitable covers to further protect your furniture from getting wet
    • Liability Disclaimer : Please note that we are not responsible for any wetness or damage caused by rain during the pick-up process.
    • Pick-Up Assistance : Kindly come with two strong persons to pick up your order. Our logistics staff will assist you in loading the furniture into your vehicle. However, for bulky items, we will need additional help from you.
    • Vehicle Compatibility : Please ask for the dimensions of the items you are picking up and measure your vehicle beforehand. We do not take responsibility if the furniture does not fit in your car. Please note, we won't unpack the furniture at our warehouse for pick-up to avoid damage during transportation. If you choose to unpack the furniture to fit it in your car, any subsequent damages will not be covered.
  11. Lay-by
    • Lay-by purchases are available at TFP AU PTY LTD discretion. To establish a lay-by, you must pay a deposit and make regular payments. The deposit amount and the due date for each payment will be agreed by both parties at the start.
    • Where can you make payments: Payments can be made online or in store. Your invoice will have the payment details.
    • Collecting your purchases: You can collect your purchases as soon as you have paid in full for the lay-by unless your order is yet to arrive. Purchases must be collected by the lay-by finalisation date printed on your receipt.
    • Lay-bys are subject to our refund policy available in our terms and conditions, see section 5 - Refund policy/orders.
    • Cancellation for non-payment or non-collection: It is your responsibility to make the regular lay-by repayments and collect your purchases by the due date. Failure to make payments when they are due or collect lay-bys by the due date will be treated as cancellation of the lay-by. TFP AU PTY LTD is not required to contact you before cancelling a lay-by for non-payment or non-collection. If your lay-by is cancelled, our refund policy will apply, see section 5 - Refund policy/orders.
  12. Warranty information
    • Products purchased at The Furniture People have the following warranties. Conditions for warranty to be applicable are:
      • You are the purchaser as per the invoice
      • Proof of purchased is presented
      • The warranty period is still valid. The defect is not as a result of normal wear and tear, misuse or is a natural characteristic of the material used.
    • What is covered?
    • Frame Warranty
      • The construction of the internal frame is covered against manufacturing and material defects.
    • Upholstery Warranty
      • Genuine Leather: We cover you if the leather splits or tears due to manufacturing and material defects.
      • Fabric: Also covered against manufacturing and material defects.
    • Component Warranty
      • The suspension system, stitching, and mechanisms (for recliners and sofa beds) are covered against defects.
    • What is excluded?
      • Discolouration of leather of fabric coverings resulting from exposure to sunlight, extreme heat or similar conditions.
      • Products used for other purposes other than residential use.
      • Surface scratches, dents, chips, marks, accidental breakages, normal wear and tear or damage resulting from misuse or abuse.
      • Normal wear and tear that will cause fillings such as polyester fibre and leather to settle.
      • The variation in the leather grain, colour variation, wrinkling, markings and scars resulting from natural features of the hide.
      • Leather sagging.
      • Piling on fabric sofas.
      • Any change to the upholstery as a result of incorrect maintenance including damage to the upholstery as a result of the application of chemicals, cleaners or conditioners not endorsed by The Furniture People.
      • Damages resulting from dye transfer from rugs, cushions, jeans and other clothing.
      • Damage to leather or fabric coverings caused by the transference of perspiration, body oils or the corrosive ingredients contained in personal care products such as hair gels and skin creams.
      • Damage incurred during handling and transportation of the product by the customer or their contractor.
      • Furniture repaired by contractors not endorsed by The Furniture People.
      • The cost of transportation from the purchaser to The Furniture People or its agents, if claim is not covered by the standard warranty conditions.
      • Natural settlement of foam and fabric or leather upholstery due to normal wear and tear.
  13. Flat-packed items claim policy 
    • When receiving your flat packed items, please ensure you follow the below guidelines in case you would like to lodge a claim for damage. All claims should be lodged within 5 business days of you receiving your item. Please notify us of your claim by sending an email to info@thefurniturepeople.com.au. Failure to follow these guidelines may result in an invalid claim.
      • If you notice any damage to the packaging, please take 2 photos, one of the entire box, and second of the damaged area PRIOR to opening the box.
      • Please check for missing parts PRIOR to mounting. If you notice any parts missing, please take 2 photos. The first photo showing all common parts grouped together on the floor. A second photo of the instruction manual, and the missing part circled.

      • Please check for any damaged parts PRIOR to mounting. If you notice any parts that are damaged, please take 3 photos. The first photo showing all common parts grouped together on the floor.   14. Loan Furniture

    We understand your need for furniture while awaiting your pre-order items, which is why we offer loan furniture as a temporary solution. Please review the following important points regarding our loan furniture policy:
    • Pickup and Delivery: The loan furniture is initially scheduled for pickup by the client. If you are unable to pick it up, we can arrange delivery for an additional cost.
    • Condition of Loan Furniture: The loan furniture should be protected and maintained in good condition. It must be returned in the same condition as it was received, with allowances for normal wear and tear.
    • Reporting Damage: If the loaned furniture becomes damaged or defective during use, please notify The Furniture People immediately. Prompt reporting is crucial for addressing any issues.
    • Penalties for Unreported Damage: If the furniture is damaged or defective and The Furniture People is not notified in a timely manner, a penalty may be applied.
    • Collection of Loan Furniture: The Furniture People will collect the loan furniture when delivering your pre-ordered items.
    • Late Return Penalty: If the client refuses to return the loaned item on the scheduled delivery date, a penalty of AUD 50 per day will be charged, accumulating until the item is returned to our warehouse.
  15. Coupon/Discount/Gifts:

    • All coupon, discount, and gift codes are non-redeemable for cash, and are not applicable to prior purchases.
    • Coupons are not valid on all items, including clearance items
    • Only one coupon can be applied per purchase.
    • Terms and Conditions for Free Shipping Coupon (MELBFREE) in Melbourne Metropolitan Areas:
      • Delivery Timeframe for In-Stock Items: When selecting Free Shipping, we commit to delivering in-stock products within 14 business days or sooner.
      • Delivery Timeframe for Pre-Orders: Once your pre-ordered item becomes available for delivery/pickup, our logistics team will reach out to coordinate.
      • Included Services with Free Shipping: For bigger items, our standard free shipping service entails delivery by one man with a van, facilitating ground floor delivery without stair access. Assembly service is not provided by default. Rubbish collection and disposal services are not included by default.
      • Additional Services: For additional services not covered by our Free Shipping offer, such as express delivery or extra personnel during delivery, please select the paid shipping options at checkout. For any inquiries, feel free to reach out to our logistics team.
